1. Acceptance of Terms

By downloading, installing, or using the SB Gold mobile application or website (the "Service"), you agree to be legally bound by these Terms & Conditions ("Terms"). If you do not agree with any of these terms, you must not use our Service.

These Terms apply to all visitors, users, and others who access or use the Service. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

SB Gold provides an online and mobile platform for browsing and inquiring about gold, silver, and diamond jewellery. The Service allows users to:

• Browse our jewellery collection organised by category and purity
• View live gold and silver price information
• Add items to a wishlist (favourites) and a cart
• Submit purchase inquiries to our team
• Track the status of their submitted inquiries

Important: SB Gold is an inquiry-based platform. Submitting a cart inquiry does not constitute a confirmed purchase or binding order. Our team will contact you to confirm availability, finalize pricing, and arrange delivery.

3. User Accounts

3.1 Registration

To submit inquiries, you must create an account by providing your name, email address, phone number, and a password. You agree to provide accurate and complete information and to keep this information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account password. You agree to notify us immediately at support@sbgold.in if you suspect any unauthorized use of your account. SB Gold is not liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Account Eligibility

You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent that you are 18 or older.

3.4 Account Deletion

You may delete your account at any time through the Profile page in the app. See our Privacy Policy for details on what data is retained after deletion.

4. Inquiries & Orders

4.1 Nature of Inquiries

Submitting an inquiry through the SB Gold app is a non-binding expression of interest. It does not create a contract of sale or guarantee availability of the item.

4.2 Inquiry Process

After you submit an inquiry, our team will:

1. Review your inquiry within 1–3 business days
2. Contact you via phone or email to confirm product details and pricing
3. Arrange payment and delivery terms directly with you

4.3 Pricing

Gold and silver prices displayed in the app are indicative rates based on the current market rate and are subject to change. Final pricing will be confirmed by our team at the time of order confirmation.

4.4 Cancellation

You may cancel an inquiry at any time before it is confirmed by our team by deleting it from the "My Inquiries" page in the app, or by contacting us directly.

5. Products & Pricing

All products listed on SB Gold are subject to availability. Product images are for representational purposes and may differ slightly from the actual product due to lighting, photography, or screen calibration.

Making charges (wastage/labour charges) will be added to the gold/silver price as applicable and will be communicated clearly during the order confirmation process.

6. Prohibited Activities

You agree NOT to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Submit false, misleading, or fraudulent inquiry information
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools, bots, or scrapers to access the Service
• Reproduce, distribute, or create derivative works of our content without written permission
• Harass, abuse, or harm other users or our staff
• Upload malicious code or interfere with the Service's functionality
• Use the app for commercial reselling or competitive intelligence

Violation of these prohibitions may result in immediate account suspension and legal action.

7. Intellectual Property

The SB Gold name, logo, app design, product photographs, and all content on the Service are the exclusive property of SB Gold and are protected by applicable Indian intellectual property laws.

You may not use, reproduce, modify, distribute, or create derivative works of any content from the Service without our express written consent.

8. Disclaimers

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure at all times
• Gold/silver prices displayed are real-time market rates (they are updated manually)
• All products listed will be available at the time of your inquiry

9. Limitation of Liability

To the maximum extent permitted by applicable law, SB Gold and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Damages resulting from unauthorized access to your account
• Any matters beyond our reasonable control

Our total liability for any claim arising from use of the Service shall not exceed ₹5,000 or the amount you paid for the transaction in question, whichever is less.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Guwahati, Assam, India.

11. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, if we believe you have violated these Terms or applicable law.

Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
